Use of myYrewards.com constitutes acceptance of the following terms and conditions (this "Agreement") by each myYrewards Member ("Member"):

1. MEMBER BENEFITS. myYrewards (the "Program") provides customers with the following benefits:
   1. Earn points that can be redeemed for rewards such as gift certificates for personal training and massage, YMCA-Branded merchandise, and other non-YMCA merchandise (DVDs, small appliances, etc).
   2. View information on the program, account status, new ways to earn myYrewards and redemption options by logging into www.myYrewards.com.
2. GENERAL TERMS AND CONDITIONS.
   1. Member must provide a valid Member ID and register online to receive all benefits associated with the Program. No purchase is necessary to become a member. Member must be a legal resident of the United States or Puerto Rico and 10 years of age or older to participate in the Program.
   2. Points may be transferred from one Member to another, provided both parties are Members. The Member transferring points to their account from another Member’s account must provide the other party’s member ID to signify permission.
   3. Member shall be responsible for maintaining accurate and updated personal information with the myYrewards.com “My Account” section of that website.
   4. YMCA Membership status will affect membership in myYrewards. If, as a YMCA member, you allow your membership to lapse because of non-renewal, your myYrewards account will terminate in 30 days. If you cancel your YMCA of Middle Tennessee membership, you will have 30 days to redeem any remaining points in your myYrewards account.
3. REWARDS
   1. Reward Points will be calculated based on a Member’s Qualifying Activities. These activities include, but are not limited to visiting any YMCA of Middle Tennessee wellness facility, registering online, annual membership, volunteerism at YMCA events, participation in wellness challenges, donations, staff idea submission, staff awards, media and PR opportunities, new member referrals, and sponsor activities.
   2. Only one visit to a YMCA of Middle Tennessee wellness facility shall be counted per day, regardless of the number of times a member visits in that day. That visit will result in twenty (20) points being added to the Member’s account.
4. REDEMPTION
   1. A Member may redeem points at any time, provided the member has enough points to complete the transaction.
   2. A Member may accumulate no more than 10,000 points at any time. When the Member’s myYrewards account reaches that ceiling (10,000 points), the member must redeem points before the Member can accrue additional points.
   3. Any tax liability incurred by the acceptance of any reward is the sole responsibility of the Member.
5. MEMBER PRIVACY. By becoming a Member of myYrewards, you agree to receive advertising, marketing materials, and other communications from the YMCA of Middle Tennessee. Your personal info will be treated as the secure property of the YMCA of Middle Tennessee. All data will be sorted in a secure database. No information will be provided to third parties. All information provided by the YMCA or the participants in the program will be used exclusively for the purposes of managing the rewards program as outlined in this document.
6. MODIFICATION AND TERMINATION. The sponsor of the Program is the YMCA of Middle Tennessee. Changes to the Program terms and conditions will be posted to the myYrewards.com website 15 days prior to the effective date. Continued use of Member’s membership card constitutes acceptance of any amendment to the Program. The most current terms and conditions of the Program can be found at www.myYrewards.com. The YMCA of Middle Tennessee may terminate the Program any time through Member notification on the website, www.myYrewards.com. Upon termination of the Program, Member shall forfeit all unredeemed rewards earned as of the termination date. Member may choose to opt out of the Program at any time; however, this may result in the forfeiture of accrued rewards.
7. GOVERNING LAW AND ARBITRATION. This Agreement shall be governed by and construed under the substantive laws of the state of Tennessee, without reference to conflict-of-laws considerations. YMCA of Middle Tennessee and Member agree that any dispute, claim, or controversy arising from or relation to this Agreement or Member’s myYrewards Membership shall be resolved by binding arbitration conducted in the state of Tennessee. YMCA of Middle Tennessee and Member acknowledge and agree that each has chosen arbitration rather than litigation to resolve any such dispute, claim or controversy. YMCA of Middle Tennessee and Member understand that a judgment on any arbitral award bay be entered in any court having jurisdiction. No arbitration under this Agreement shall be consolidated with any other arbitration.
8. NO WARRANTY. YMCA of Middle Tennessee and their respective officers, directors, employees and agents make no warranty, express or implied, including but not limited to any warranties or merchantability or fitness for a particular purpose with respect to the Membership or any products or services related thereto.
9. RELEASE OF LIABILITY. Member hereby releases the YMCA of Middle Tennessee and its affiliate entities and their respective officers, directors, employees and agents from and against any and all liability relating to Member’s myYrewards Membership, Rewards or this Agreement.
